Jason M. Murphy obtains 9-0 Defense Verdict in Southern District Real Estate Dispute

Jason Murphy appeared for a jury trial in the U.S. District Court, Southern District of California, before Judge M. James Lorenz, to defend against a claim of failure to disclose against a luxury property real estate broker, related to the sale of a luxury home in La Jolla, California in 2011. Plaintiff asserted claims in excess of $1,000,000 based on theories of fraud, misrepresentation, concealment and negligence related to beach access and the advertising and promotion of the home.

Jason argued the lack of liability due to comparative fault by the Plaintiff, and the managing agent of the plaintiff’s LLC. In addition, the defense experts opined the Defendant met the standard of care for his actions in the transaction. Plaintiff’s counsel asked the jury to award in excess of $800,000 for damages, and an additional $800,000 for punitive damages.  The jury agreed with the defense 9-0 on all claims.
